Elisa is an Associate in the Employment team at McCabe Curwood. Elisa works on a range of matters involving employment law and industrial law.
Elisa prepares and revises all employment-related documentation, including contracts of employment for permanent, fixed-term and casual staff, contractor agreements, employee handbooks and workplace policies including bullying and harassment, workplace surveillance, social media, grievances and disciplinary action.
Elisa assist clients to understand their obligations under the relevant legislation and industrial instruments, including modern awards and enterprise agreement. Her experience in this area also extends to assisting clients in investigations by the Fair Work Ombudsman for non-compliance, including in respect of allegations regarding underpayments and record-keeping.
She also provides employers with advice about, and helps draft documents for, termination of employment. This includes termination for reasons relating to performance, misconduct and redundancy. She regularly advises on restraint of trade matters.
Elisa undertakes workplace investigations into allegations of misconduct, including bullying and harassment. This involves interviewing complainants, respondents and relevant witnesses to determine whether the alleged behaviour has taken place and recommending an appropriate course of action.
Elisa also supports the Corporate team at McCabe Curwood by completing employment-related due diligence in respect of mergers and acquisitions, whether they be by way of a share purchase or sale of business assets.
Elisa recently instructed counsel in a week-long discrimination matter before NCAT.
